Common Questions About Appeals Law in Arkansas

  • What qualifies as grounds for an appeal?

Appeals are based on legal errors, misconduct, new evidence, or violations of constitutional rights. We analyze trial records to determine if mistakes justify an appeal.

  • How long do I have to file an appeal?

In Arkansas, you must file a Notice of Appeal with the trial court within thirty days of entry of the final judgment. After you file a Notice, you then have ninety days to lodge the record and transcript with the Court of Appeals. You then have to submit your brief detailing what you believe the trial court did incorrectly.

  • Can I introduce new evidence during an appeal?

Generally, appeals focus on errors in the original trial, but some cases allow new evidence if it could significantly impact the outcome.

  • What happens if my appeal is denied?

If an appeal is denied, further options may be available, such as seeking post-conviction relief or filing with a higher court.

  • Do I need a different attorney for an appeal?

Appeals require a different legal approach than trials, so working with an attorney experienced in appellate law increases the chances of success–we can help.
